Frustration

When we made an offer on our new house we put that we would close on or before August 3rd. That offer was accepted and so that was our plan. We were right on schedule and we had actually asked the seller if we had completed some paperwork that he wanted if he would mind if we got into the house now and started to clean and paint. It is a vacant house and so it should have been no problem. He agreed as long as we had a clear to close and a completed HUD statement. We went ahead and bought paint as those documents were being finished up. We started to box up things in our house and we also ordered furniture that should be in next week (or our original expected closing date).

While the title company was working on our HUD they came across a lien placed on the property that the seller knew nothing about. Now I don't totally understand all of this but our lawyer said that he isn't surprised that the seller didn't know because it was somehow placed on the property after the seller got the title but before the deed was transferred. Our seller bought the house as a foreclosure and completely remodeled the house. He's only owned it since 2008. Our soon-to-be neighbor is the person who placed the lien on the house, claiming she has not been paid for $41,000 worth of work done on the property. She was intending for it to be placed on the bank that foreclosed on the original owner (her son).

Our lawyer said that the woman placed the lien without an attorney and that it would never hold up in court. He said that best case scenario she could just sign a document to dismiss the lien, but that it wasn't likely she would do that. Worst case scenario they would have to take this to court which can be drug out for a while. He didn't seem to think there would be any way that we wouldn't get the house, we just may have to wait a while. My frustration is building even more because our seller's realtor is a real piece of work. He never responds to calls or emails and even got into a little tiff with our realtor. They have not given us any updates as to where they are in the process. We know the title company explained to the seller what the problem is and what needs to be done, but we don't know what he has done at this point. We can't close until he gets the lien removed.

As I said, we ordered new furniture. In fact, we ordered a bedroom set for us, an entertainment center, a couch, a love seat, a chair and ottoman, a coffee table, two end tables, a leaning book shelf, a dining room table and chairs and a small pub type of table for the eat-in kitchen. That being said there is no way we can store that furniture in our current house and I don't really want to put our brand new furniture into storage somewhere. We are living with a bunch of boxes everywhere, which is incredibly annoying. On top of that we are getting very near the beginning of the school year. I can't get into my classroom to begin working on that while I wait for the house issues to clear because our building is still being worked on from the tornado damage and Wes can't get into his room either because they have major construction going on in his building to add air conditioning, new hallways, a new gym and a few new classrooms. He is also moving to kindergarten this year and so that means another classroom to move. This is all majorally stressing me out because we have just been sitting around doing nothing these last few weeks and then I'm afraid that all of this is going to come to a head at the same time. I know that we have wonderful family members that will help us out, but I just worry about how we will manage all of that at the same time. However, I do know that God won't give you more than you can handle ~ even if you think you can't handle something you just figure it out. I've done that before.
